Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of ClawStart services, including AI agent setup, deployment, optimization, and ongoing support ("Services"). By engaging with ClawStart, you agree to these terms.

2. Services

ClawStart provides:

• Discovery and consultation for AI agent deployment
• Custom agent design and configuration
• Integration with your tools and infrastructure
• Deployment and testing services
• Ongoing monitoring, optimization, and support

Clients are responsible for providing necessary API keys, credentials, and access to third-party services. ClawStart never stores API keys or credentials; clients retain full control.

3. Infrastructure & Ownership

You own your infrastructure, your agent, and all associated data. ClawStart does not host your agent unless explicitly contracted. You may choose to host on DigitalOcean, AWS, or your own systems. You are responsible for infrastructure costs and security.

4. Payment & Billing

Setup fees are one-time, non-refundable after 30 days (unless stated otherwise). Monthly support fees are billed at the start of each billing cycle. Failure to pay may result in suspension of services.

5. Cancellation & Refunds

You may cancel ongoing support at any time with 30 days' notice. Your agent will continue running; you own it completely. If you are unsatisfied with initial setup within 30 days, we offer a full refund of setup fees (less any third-party costs incurred).

6. Limitation of Liability

ClawStart's total liability for any claim related to the Services is limited to the amount you paid for the Services in the 12 months preceding the claim. ClawStart is not liable for indirect, incidental, or consequential damages.

7. Indemnification

You agree to indemnify ClawStart from any claims, damages, or losses arising from your use of the Services, your infrastructure, or your agent's actions.

8. Confidentiality

ClawStart maintains confidentiality of your business information. We do not share your data with third parties except as required to deliver Services or comply with law.

9. Disclaimer of Warranties

Services are provided "as-is" without warranties of any kind, express or implied. ClawStart does not guarantee uptime, error-free operation, or specific business outcomes. AI agents are complex systems and may require ongoing optimization.

10. Changes to Terms

ClawStart may update these Terms at any time. Continued use of Services constitutes acceptance of updated Terms. We will notify you of material changes via email.

11. Governing Law

These Terms are governed by the laws of the State of Florida. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Florida.
